After pardon, Daniel Silveira takes office as a member of the CCJ; choice may benefit him

MANAUS – Federal Lawmaker Daniel Silveira (PTB-RJ) became a full member of the Constitution and Justice Commission (CCJ) of the House of Representatives, the most important collegiate of the house. The choice was made on Wednesday, 27. The ally of Jair Bolsonaro (PL) was also elected 1st vice-president of the Commission for Security and Combating Organized Crime.

The choice opens the margin for Silveira to benefit, since among the attributions of the CCJ is the voting and discussion of the processes about the loss of mandate of the lawmakers. It is precisely the determination of the judiciary to the lawmaker, a week ago the congressman was sentenced by the Supreme Court (STF) to eight years and nine months in prison for anti-democratic acts and then pardoned by the president.

The appointment was the target of criticism among parliamentarians, Tabata Amaral (PSB-SP) spoke out on social networks and posted a video showing Silveira in the collegiate room, considering the episode a “mockery”. It is worth noting that, besides the CCJ, Daniel Silveira was appointed to other committees: Education, Sports, Public Safety, and Culture.

Last Wednesday, April 20, Silveira was sentenced to 8 years and 9 months in prison for the crimes of attempting to prevent the free exercise of power and coercion in the course of proceedings. He was a defendant at the Supreme Court as a result of the inquiry into antidemocratic acts.

With the decision, Silveira was also sentenced to the loss of the parliamentary mandate and the suspension of political rights after the end of the appeals, penalties that can make the congressman temporarily ineligible.

The lawmaker must also pay about R$200,000 in fines for the conviction. The sentences will not be carried out immediately because an appeal is still pending, but the lawmaker may already be framed in the Ficha Limpa Law, in a possible attempt to run in the October elections.

One of the Bolsonarist supporters best known to the population, Silveira released videos attacking the ministers of the STF and calling for a military coup in the country. The conviction of the former congressman mobilized the Bolsonaro base, and the next day President Jair Bolsonaro announced a decree in which he granted “grace” to Daniel Silveira. Grace is the legal term for a pardon of an individual’s sentence.
