Braga’s cassation request against Wilson is rejected by three of the seven members of the TRE-AM

MANAUS – The embargo request of the senator for Amazonas Eduardo Braga (MDB) against the governor of the state, Wilson Lima (Union Brazil), re-elected in the 2022 elections, was rejected on the morning of Monday, 12, by three of the seven members of the Court of the Regional Electoral Court of Amazonas (TRE-AM) judging the case. The trial was suspended after a request for examination by Judge Kon Tsi Wang.

The representation of number 0602276-66.2022.6.04.0000 asks for the impeachment of Wilson Lima’s candidacy for using the structure of the Amazonas State Security Forces. In the request, Braga’s lawyers allege the use of personnel and vehicles in advertisements broadcast on television and social networks during the election campaign.

The rapporteur of the case, Judge Carla Reis, presented an amendment in which she justifies that the “motions filed do not serve to rediscuss the merits already settled by the Court. The magistrate also states that the “collection of factual evidence in the record was considered sufficient to the formation of conviction and the respective rendering of condemnatory decision for practice of prohibited conduct.

Rejecting the motion

During the session, members of the Court Fabricio Marques and Marcelo Pires advanced their votes and followed the understanding of the rapporteur, in agreement for the rejection of the motions. Thus, the score of the vote shows three votes against the representation.

The regional electoral prosecutor, Catarina Sales, of the Electoral Prosecutor’s Office, argued for the rejection of the request. “The Public Prosecutor’s Office concluded that there is no omission or contradiction in the decision of this court and it is manifested by the rejection of all the motions“, she said.

In resuming the trial, must vote still members of the Electoral Court Kon Tsi Wang, Marcelo Soares and Victor Liuzzi. The president of the TRE-AM, Judge Jorge Lins, will only vote in case of a tie. The new date of the agenda has not yet been published in the electronic panel of the collegiate sessions.
