Minister Alexandre de Moraes is drawn as rapporteur in ADI of the AM Government and Solidariedade against reduction of IPI

MANAUS – The minister Alexandre de Moraes was drawn as rapporteur of the new Actions of Unconstitutionality (ADI) filed on the morning of Monday, 2, by the governor of Amazonas, Wilson Lima, and Solidarity party, against the IPI reduction decrees, signed by President Jair Bolsonaro, which harm the competitiveness of the Amazon.

In the new actions, Solidariedade, through ADI 7153, challenges three federal decrees (11.047/2022, 11.052/2022 and 11.055/2022), which expand from 25% to 35% the linear reduction of the tax and zero the IPI rate on concentrates. The party’s argument is that the way the IPI tax reduction was implemented alters the competitiveness of the Free Trade Zone.

Governor Wilson Lima, through ADI 7155, questions the same decrees and claims that the tax reduction for the rest of Brazil can cause incalculable damage to the State of Amazonas.

Hearing postponed

A conciliation hearing had been scheduled for this Tuesday, 3, but was canceled after a request from the Attorney General of the State (PGE-AM). According to the state government, the judicial measures adopted are aimed at preserving the constitutional rights of the Manaus Free Trade Zone, which is responsible for more than 100,000 jobs in the Manaus Industrial Pole, and is configured as a regional development model that generates income, tax revenue, and environmental preservation in Amazonas, the largest state in the Amazon Region.

The attorney general of the State, Giordano Bruno Costa da Cruz, explained that because Decree No. 11,047/2022, which was the basis for the ADI presented by the State, was revoked, there was a supervening loss of object of the action. “Thus, the extinction of the action is something in accordance with the case law of the STF. We will file a new ADI questioning the constitutionality of the most recent decree (11.055/2022), “clarified the holder of PGE-AM.
