TRE-AM identifies irregularities in Alfredo Nascimento’s bank accounts for the 2022 elections and recommends disapproval

MANAUS – The judge Marcelo Pires Soares, of the Regional Electoral Court of Amazonas (TRE-AM), found, in conclusive opinion, irregularities in the provision of expenses incurred by the former mayor of Manaus Mr. Alfredo Nascimento, during the election campaign 2022, and recommended the disapproval of his accounts. The Electoral Public Ministry (MPE) followed the decision. At the time, Mr. Nascimento ran for federal lawmaker for the Liberal Party (PL).

Mr. Soares determined the conversion of the judgment of Mr. Nascimento’s expenses into diligence – that is, the magistrate concluded that new steps need to be taken before sentencing.

According to the technical report, there was no record of candidates who received cash donations, sent by Mr. Nascimento, for the production of graphic campaign material. “(…) the analyst did not inform whether the corresponding financial expense had been effectively proven by a valid tax document. This information is relevant to define if, in fact, there are irregularities in the provider’s accounts”, says an excerpt of the report.

Mr. Soares points out that, although the printing of graphic material relating to the donation to the then candidate for state representative Mr. Anilson Duarte da Rocha (PL) has been proven through the invoice, “there was omission of expenses by the beneficiary”. The TRE-AM also found gaps relating to fuel expenses, amounting to R$ 2 thousand, and content boosting, totaling R $ 170.800 thousand.

However, the magistrate notes that “with regard to fuel expenses, it appears that were recorded invoices 2183 (ID 11524601) and 4325 (ID 11524648) totaling exactly R$ 2,000.00 (two thousand reais)”. A similar situation occurred with the registration of two expenses with Facebook, totaling the same amount intended for boosting on the social network and pointed out as irregular by the accounts analyst.

Misuse of purpose

The court’s analysis also identified “possible misuse of purpose in relation to the distribution of public resources according to race quota”, due to the absence of information such as race indication in the candidacy registration. The provider also did not clarify whether there was donation of resources to other candidates or mere sharing of graphic material.

In relation to expenses with chartering aircraft, the TRE-AM noted that the provider failed to submit the list of passengers carried on the trip, “which makes it impossible to control the relevance of the expense with the campaign”.

Mr. Alfredo Nascimento’s brother, Evilázio Nascimento, said that the party’s lawyer is following the diligence. “He will await the results and then, if necessary, speak on the matter.”
