STF Justice Cármem Lúcia to make inspection in Vale do Javari after Bruno and Dom’s deaths in the Amazon

BRASILIA – The minister of the Federal Supreme Court (STF) Cármen Lúcia will represent the judiciary in the expeditions to the Javari Valley, region where the licensed employee of the National Indian Foundation (FUNAI) Bruno Pereira and the british journalist Dominic Mark Phillips, aka “Dom Phillips” were murdered. The trip is scheduled to take place on Thursday 30th and Friday 1st. Cármen Lúcia is the rapporteur of six of the seven actions of the “green agenda” – a group of lawsuits filed against environmental policies of the Bolsonaro government – in the Supreme Court.

A source involved in the organization of the trip informed CENARIUM MAGAZINE that the minister’s name is on the schedule, but confirmation will be made until Wednesday 29th. When questioned, the communication department of the STF has not confirmed or denied, so far, the presence of the magistrate in the trip. The measure arose from external commissions created in the House of Representatives and the Senate to monitor the investigations into the case.

The invitation for the participation of Carmen Lúcia in monitoring the investigations came from the legal advisor of the Union of Indigenous Peoples of Vale do Javari (Univaja) Eliesio Marubo.

In addition to Carmen Lúcia, senators Randolfe Rodrigues (Rede-AP), Nelsinho Trad (PSD-MS), Fabiano Contarato (PT-ES), Leila Barros (PDT-DF), and Eduardo Velloso (União-AC) are also going so far; from the House of Representatives are confirmed: federal lawmakers José Ricardo (PT-AM), Joenia Wapichana (Rede-RR), Vivi Reis (Pol-PA), João Daniel (PT-SE), Rodrigo Agostinho (PT-SP), Erika Kokay (PT-DF) and Reginaldo Lopes (PT-MG).

ADPF at the STF

The Articulation of Indigenous Peoples of Brazil (Apib) filed, soon after the disappearances of Bruno Araújo Pereira and Dom Phillips, a petition in the context of the Argument of Noncompliance with Fundamental Precept (ADPF) 709, notifying the STF about the case. The minister Luís Roberto Barroso, rapporteur of the ADPF, determined at the time that the federal government should take all necessary steps to locate the indigenous leader and the british journalist.

Barroso noted that both performed activities to strengthen territorial protection against invaders, supporting a local indigenous organization, due to the insufficiency of state action, even with decisions of the STF in this regard. The minister also pointed out that the disappearance occurred in the area of the sanitary barrier, determined in ADPF 709, which was intended to protect the entrance of the Indigenous Land of Vale do Javari.

MPF recommends structuring

On Monday, 27, the Federal Public Ministry (MPF) recommended that the Union and Funai adopt measures to structure and modernize the Ethno-Environmental Protection Bases (Bases de Proteção Etnoambiental – Bape) in the Javari Valley. The agency found that the structure available to the agents of the National Security Force working in the region is precarious, and there is a shortage of personnel in the team itself. The deadline for comment on the fulfillment of the recommendation is 10 days.

The MPF found that the staff of the National Public Security Force acting in the Ethnoenvironmental Protection Base (Bape) of the Ituí-Itaquaí river, where Bruno Araújo Pereira and Dom Phillips died, has, in most cases, only two to three agents. The investigation also noted the precarious logistics, administrative, and personnel structure provided by FUNAI.

Follow-up of the investigations

One of the objectives of the expedition in Amazonas is “to know how the investigation is going, to hear the Federal Police”, as informed by Senator Randolfe Rodrigues to CEARIUM MAGAZINE last week. However, on Monday, 27, the superintendent of the body in the state, Eduardo Fontes, said that no meeting with him has been requested. Regarding the progress of the investigations, Fontes limited himself to saying that Gabriel Pereira Dantas, who turned himself in to the Civil Police of São Paulo claiming to have participated in the murder, has not presented more conclusive evidence of his involvement in the case.
