Federal Court triggers PF to reinstate public road after non-compliance with decision in protests of Bolsonarists

MANAUS – In a new decision, granted on the night of Wednesday, 16, the federal judge Jaiza Maria Pinto Fraxe determined the repossession of the public street in front of the Amazon Military Command (CMA), West zone of Manaus, where it happens since the day 2 November the antidemocratic demonstration that does not recognize the result of the presidential election this year. The measure accedes to the request of the Federal Public Ministry (MPF).

The magistrate also holds the Government of Amazonas and Manaus City Hall responsible for any traffic accident that happens because of the irregular occupation of the existing bike path area in place.

“It is hereby consigned that, in case of appearance of any victim (fatal or not), the holders of the municipal traffic body (and on the point of sharing responsibility also the holder of the state body), may respond in co-authorship, along with drivers, vehicle owners and movement leaders. Illicit acts are materialized and exhausted by action or OMISSION. The responsibility is the same”, brings the decision.

According to the judge, in inspection carried out at 19h of Wednesday, 16, it was found the permanence of very serious illegalities “that expose the life of the manauara population to risk of high potential damage”, as irregular parking on the bike path and its total obstruction in front of the CMA, disregarding previous decision to correct illegalities, issued on the holiday on November 15.

“The conclusion I reach is that the movement continues in illegality, either by obstruction of roads, by offering suspicious food and in disagreement with the laws, or by promoting acts similar to anarchy – when the country is a Federative Republic and we all must obey the laws and the Constitution. The moment is to identify the authors of infractions, because they will be held accountable in time, form and manner”, concludes the magistrate, appointing a Federal Police agent to assist in the inspections and other necessary acts for the good progress of the action.

In the event that the omission and traffic infractions persist or return noise environmental infraction and practice of offering children and adolescents to vulnerability, further legal measures will be adopted for immediate identification and accountability of the leaders and other suspects.
